Heard the learned counsel for the applicant and the learned APP for first and second respondents. In view of the averments made in the application, a case for restoration is made out.

Accordingly, the application is allowed in terms of prayer clauses (a) to (d) subject to condition of the applicant serving a private notice to the third respondent and filing proper affidavit of service on or before 18th November 2016. If compliance is not made, order of dismissal shall stand.
