On the other hand, learned counsel appearing for respondent submits that the delay has not been properly explained, therefore, application for condonation of delay may be rejected. 4.

Upon appreciating the rival contentions and perusal of the averments in the application, we are satisfed that the delay deserves to be condoned. Accordingly, the delay in fling application seeking leave to appeal stands condoned. The application for condonation of delay stands disposed of.
