The appellant is convicted for an offence punishable under section 14(a) of the Foreigners Act, 1946 and Sec. 3(a)6 of Passport(Entry into India) Rule 1950 and sentenced to suffer S.I. for 3 years by Assistant Sessions Judge, Thane in Sessions Case No. 435 of 2014. In view of this, the appeal would lie before the Sessions Court. Learned Counsel for the appellant is at liberty to file an application seeking return of the certified copy. The appellant herein is granted liberty to file appeal before the Sessions Court, Thane, which shall consider it on its own merits.
