It is submitted, upon instructions and the relevant records that the learned Sessions Judge seized with Sessions Case No.873 of 2015 has directed to expedite the trial by order dated 6.8.2016. In the present case, charge is framed. As far as the contention of the applicant that he has been diagnosed with HIV, the learned Sessions Judge on humanitarian ground has also directed the jail authorities to provide medical treatment along with Antiretroviral Therapy (A.R.T) in J.J. Hospital, Mumbai. In view of this, it would not be appropriate to consider an application under Section 439 of Cr.P.C. as the trial has been expedited and the applicant is being provided

The learned Advocate appointed has put in his best efforts to espouse the cause of the applicant. Hence, his professional fees are quantified at Rs.1,000/- (Rupees one thousand only), to be paid to the Advocate appointed within three months from today. 4.
