This is an application for bail filed by the aforesaid applicant in Sessions Case No. 912 of 2009 for offence under Section 343, 363, 366(A), 372, 373 r/w. 34 of the Indian Penal Code and Section 3. 4, 5 and 6 of PITA Act.

The applicant was initially released on bail by order dated 30.06.2008. It reveals that the applicant failed to remain present in the court since 2011 and was arrested only in the year 2015. The applicant has violated the conditions of bail and had not remained pps

Though the learned Counsel for the applicant has stated that the applicant was unable to attend the court due to her sickness, the applicant has not produced any medical certificate or any other material to show that the applicant was suffering from any ailment. The applicant has not shown any sufficient cause for not remaining present before the court.

Considering the facts and circumstances, the applicant is not entitled for bail. Hence the application for bail is dismissed. (ANUJA PRABHUDESSAI, J.) pps
