This is an application under Section 439 of Criminal Procedure Code filed by the aforesaid applicant, who has been arrested in C.R.No.346/2018 registered at Phaltan Rural Police Station, District Satara for offences punishable under sections 353 and 379 of the Indian Penal Code.

Heard Mr. Sidheshwar N. Biradar, learned counsel for the applicant and Mr. S.R. Agarkar, learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsels for the respective parties.

The aforesaid crime was registered pursuant to the first 1/3

information report lodged by Vilas Yadav - Assistant Sub-Inspector of Phaltan Gramin Police Station against the applicant for illegal transportation or theft of sand and also for obstructing him in discharging his official duties.

The applicant was arrested on 23/08/2018 and is presently in judicial custody. Mr. S.R. Agarkar, learned APP submits that the investigation is complete and that the charge sheet will be filed within 15 days. The presence of the applicant is no longer required in judicial custody. The applicant is a permanent resident of the State and there are no chances of him absconding and/or thwarting the course of justice. Hence, the Bail Application is allowed on following terms and conditions :- (a) The applicant who is arrested in C.R.No.346/2018 is ordered to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Fifty Thousand) with one or two solvent sureties in the like amount, to the satisfaction of Investigation Officer. (b) The applicant shall remain present before the Investigation Officer as and when required by the Investigation Officer for the purpose of investigation.

(c) The applicant shall furnish his permanent address and temporary address, if any, and his contact details to the Investigation Officer. (d) The applicant shall not change his residential address without prior intimation to the Investigation Officer. (e) The applicant shall not interfere with the witnesses in any manner.
