P.C.:- By reasoned Order dated 11th September, 2018, the Applicant was granted interim relief and was directed to attend the concerned police station on stipulated dates, to join the process of investigation.
Heard the learned counsel for the Applicant and the learned APP. Perused the record of investigation. The learned APP, on instructions, submitted that the Applicant has complied with the said condition. A perusal of the first information report and record of investigation indicate that, the relationship between the informant 1/2
ssm 2 13-aba1848.18.doc and the Applicant was consensual. That, the medical examination of the Applicant and other related aspects pertaining to the investigation are already completed by the police.
In view of the above, this Court is of the opinion that the custodial interrogation of the Applicant for further investigation of the present crime is not necessary.
Interim relief granted by Order dated 11th September, 2018 is hereby confirmed. However, it is clarified that the Applicant shall attend the Investigating Officer as and when called for between 10.00 a.m. to 12.00 noon, on receipt of a notice in writing till submission of the final report.
