This petition was admitted on 26th October, 2016. It challenges a notice dated 23 rd March, 2016 under Section 148 of the Income Tax Act, 1961 (the Act) seeking to re-open assessment for the assessment year 2010-11. At the time of admission, interim reliefs restraining respondent revenue from proceeding further with the impugned re-opening notice was also granted. 2.

Ms. Shirke, learned Counsel appearing for the Revenue states that the impugned notice dated 23 rd March, 2016 seeking to re-open assessment for 2010-11 has been withdrawn by letter dated 20 th November, 2016.

In view of the above, Mr. Vimal Gupta, learned Senior Counsel appearing for the petitioners states that nothing survives in the petition and therefore he seeks to withdraw the petition.
