2/2 (29).doc Mr.Shaikh, learned APP, on instructions makes a statement that subject FIR is investigated and thereafter "B" Summary report is filed in the Court. Statement is accepted. In the light of above, learned counsel for the petitioner fairly concedes that the grievance raised in the petition no more survives.

Respondent no.2 is also at liberty to file Protest Petition and contest the B Summary report before the Magistrate.

Subject to above, Application is disposed of. In view of the disposal of Criminal Application No.1009/17, Criminal Application No.416/2018 does not survive and stands disposed of.
