Both these Applicants who are charge-sheeted in Crime no. 240 of 2018 for offence punishable under Sections 306, 420 r/w 34 of the Indian Penal Code are arrested on 09th and 11th of June 2018. It is really unfortunate to notice that the opinion sought from the Chief Examiner of Documents, State Government is pending since July 2018 wherein the opinion is sought on the suicide note which was seized in the crime in question.

2 42.2341.18 ba .doc In the aforesaid background, it will be appropriate in my opinion to direct the Chief Examiner of Documents, Crime Investigation Department, Government of Maharashtra, Pune to furnish the opinion as was sought in crime no. 240 of 2018 registered with Mahatma Phule Chowk Police Station, Kalyan, District: Thane, within period of four weeks from the date of production of this order by the Investigating Officer. The Investigating Officer shall collect the said opinion and file supplementary charge-sheet within period of two weeks from the date of receipt of such opinion. In the above background, the Application stands disposed of as withdrawn. It is clarified that this Court has not examined the merits of the matter and it will be open for the Applicants to apply afresh before the learned Sessions Court in view of the aforesaid change in the circumstances. The Application stands disposed of.
