1] The learned Special P.P on instructions submitted that, the trial of the present crime i.e. Special Case No.8 of 2011 has commenced and as of today three witnesses have already been examined. She further submitted that PW No.4 is being cross-examined. She also submitted that, as far as the absconding accused Madathil Jacob is concerned, the prosecution has adopted appropriate proceedings for separating trial of the said accused person from other accused. She further on instructions submitted that there are about twenty more witnesses which have been cited by the prosecution in support of its case and recording of its evidence most probably will be completed within six months from today. 1/2
ba.2048-2016.doc 2] In view of the above, the learned Counsel for the applicant on instructions seeks leave to withdraw the present application with a prayer for direction to the Trial Court that it may be directed to conclude the hearing of the Special Case No.8 of 2011 within some stipulated period. 3] In view of the statement made by the learned Special P.P on instructions, the learned Special Judge having charge of Special Case No.8 of 20188 is requested to make an endevour to conclude the trial pertaining to Special Case No.8 of 2011 at the earliest and preferably within a period of nine months from the date of receipt of this Order. 4] Application is disposed off as withdrawn with aforesaid directions.
