1] This is an application under Section 439 of Cr. P.C. for bail in CR No. 600 of 2016 dated 19.12.2016 registered with Wadala TT Police Station, Mumbai under Section 307, 323, 504 r/w 34 of the Indian Penal Code.

2] Heard the learned Counsel for the applicant and the learned APP. Perused the record annexed to the application. 3] It is the prosecution case that, due to some earlier minor altercation which took place between the first informant Abhishek Pinge, 1/2

BA.2206-2017.doc and applicant, the applicant on 18.12.2016 at about 10.30 p.m assaulted the first informant with a knife on his chest. The Injury Certificate issued by L.T.M.G. Hospital, Sion, Mumbai mentions that, there was a penetrating wound suffered by the first informant on chest with broken ribs and the said injury is grievous in nature. Apart from the said fact, there are six antecedents at the discredit of the applicant. When applicant was on bail in earlier crime, it is alleged that he has committed the present crime. The learned APP submitted that the applicant is a habitual offender and if he is released on bail, he may abscond and/or indulge in similar type of crime. 4] In view of the above and after perusing the record, this Court is of the view that the applicant does not deserve to be released on bail. Application is accordingly rejected.
