Learned counsel for the applicant on instructions seeks leave to withdraw the application since the charge-sheet has now been filed with liberty to file a fresh application before the trial Court for regular bail.

A request is made by learned counsel for the applicant that should the application for regular bail is filed, the same be decided expeditiously considering that the applicant is a woman. Needless to mention the trial Court will obviously be guided by the provisions of Code of Criminal Procedure in respect of the request that is made by the applicant. If possible the trial Court is requested to expedite the hearing of the bail application, if filed.

It is made clear that I have not expressed any observations on the merits of the matter. The application for bail if filed be decided on its own merits and in accordance with law.

The application is allowed to be withdrawn with liberty as prayed for and disposed of accordingly.
