In pursuance of Order dated 16th June 2023, Deputy Registrar, Main Mediation Centre, High Court, Mumbai, has submitted his detailed explanation with forwarding letter dated 30th June 2023. The same is accepted and taken on record.

In furtherance of directions issued in Paragraph No.3 of Order dated 16th June 2023, Shri Avinash Palwe, ACP, Megwadi Division, Mumbai, has filed an Affidavit dated 28th June 2023. It is stated in Paragraph No.4 thereof that, it is Respondent No.2, the informant, who persistently followed up the matter with Investigating Officer, from April 2023, for filing charge-sheet in the present crime. She also wrote a letter to the Senior Inspector of Police, Meghwadi Police Station, Mumbai by an email and therefore the Investigating Officer issued the said notices. The explanation offered by the ACP, Meghwadi Division, Mumbai, is accepted. 3.

The Deputy Registrar, Mediation Center, High Court, Mumbai with his covering letter dated 1st July 2023 has forwarded a Report of Mediator in a sealed envelope. The said envelope is opened in the Court. It is stated therein that, the mediation has failed. The said Report is taken on record. 4.

Heard learned counsel for Petitioners and Respondent No.2. 5.

It is an admitted fact on record that, after completion of investigation the Police have submitted charge-sheet. In view thereof, learned counsel 2/3

S S KADAM 4-wp-4189-2022.doc for Petitioners, on instructions seeks leave to withdraw the Petitions with liberty to file applications for discharge, as contemplated under the provisions of Criminal Procedure Code, before the Trial Court. Leave and liberty granted.
