1. The learned Counsel for the respondent raised a preliminary objection with regard to the maintainability of the application. He submitted that section 23 of the Code of Civil Procedure, 1908 would apply in this case and therefore, Advocate has to make application to the Appellate Court in Sangli District and the present application is not maintainable.

2. Upon hearing this submission, the learned Counsel for the applicant seeks to withdraw this application with liberty to make an application before the Sangli court.

3. The application is disposed of as withdrawn with liberty as prayed for.
