The applicant seeks transit bail since he apprehends arrest at the hands of the State Vigilance, Una Police Station, State of Himachal Pradesh in C.R. No.006 of 2022 registered on 24 September, 2022. The subject C.R. invokes offences punishable under Sections 409, 467, 471, 477-A and 120-B of the IPC and under Sections 31(1)(a) and 13(2) of the Prevention of Corruption Act, 1988.

When the FIR is perused, it can be seen that the complaint was lodged on 02 January, 2021 alleging that a scam of Rs.80 Lakhs was committed in the KCCB, GC Branch Una by the then Branch Manager in connivance with some other persons.

The applicant is arraigned as accused no.3 and as far as the present applicant is concerned, it is alleged in the complaint that he is

911.ABA2767-22.doc the guarantor for the loan of one Chander Kant to the tune of Rs. 20 Lakhs.

Considering the nature of accusation and the eminent threat of arrest, I deem it appropriate to protect the applicant by releasing him on temporary/transit bail for a period of four weeks. Hence the following order:-

ORDER

(a) Application is allowed.

(b) In the event of arrest in connection with C.R. No.006 of 2022 registered with State Vigilance, Una Police Station, State of Himachal Pradesh, the applicant shall be released on transit bail for a period of four weeks.

(c) The protection granted to the applicant shall come to an end after expiry of four weeks. During the said period of four weeks, the applicant shall approach the competent Court and seek his release on bail.
