The learned counsel submits that in view of the provisions of the Maharashtra Employees of the Private Schools (Conditions of Services) Regulations Act 1977, the Petitioner being senior ought to have been promoted instead Respondent No.3 is promoted as a Principal though junior to the Petitioner. 2.

In that event, the case would be of supersession. The Petitioner has remedy of Appeal under Section 9 of the Regulation, 1977.

The Writ Petition as such is disposed of with liberty to the Petitioner to avail the remedy as available under the statute. 4.

In that event, all contentions are kept upon. No costs.
