The case of the prosecution is that the Truck of the applicant was parked on road and the deceased came from behind and dashed the said Truck.

Having considered the case of the prosecution, it is unlikely that the revision is likely to be heard in near future. The sentence imposed on the applicant is of one (1) month.

Therefore, the sentence imposed by judgment and order passed by the learned Judicial Magistrate First Class, Sinnar Nashik in Summary Criminal Case No. 447 of 2011 dated 28th February, 2012 confirmed by the learned Additional Sessions Judge, Nashik in Criminal Appeal No. 99 of 2017 on 1st August, 2022 is suspended during the pendency of the Revision. 5.

Interim Application stands disposed of in above terms. No costs.
