Having heard Ms. Awasthi, learned counsel for the petitioners for some time, Mr. Shaikh, learned APP, on instructions of the officer concerned viz. Mr. Sanjay Patil-PI, Shil Daighar Police Station, Thane City, who is present before the Court today, makes a statement that as of today, no FIR has been registered against the petitioners in pursuance of the directions contained in the letter of the Tehsildar dated 3rd September, 2018. He further makes a statement that, in case, the FIR is registered, the petitioners would be given 72 hours notice before arrest. The statement is accepted as an undertaking to this Court. In the light of the above statement, the learned counsel for the petitioners, submits that at this stage, the grievance raised in the petition no more survives. She seeks leave to withdraw the petition. Leave as prayed for, is granted. The writ petition is disposed of. 3.

It is made clear that we have not gone into the merits of the matter and, all rights and contentions of the respective parties are kept expressly open.
