Mr.Godbole, learned counsel for the Petitioners states that private service has been effected on the Respondents. 3.

In this case, there is no necessity to entertain the present

However, since Mr.Godbole states that the suit was instituted by the Petitioner in the year 2003 and most of the suits instituted in or around 2003 under the Presidency Small Causes Court, 1882 have already been disposed of, there is no reason to presume on the basis that the Small Causes Court will not take steps to see that even this suit is expeditiously disposed of. In case there is any grievance in the matter of unnecessary adjournments, it is always open for the Petitioners to oppose such adjournments on the ground that it is an old matter.

With the aforesaid observations, this petition is not entertained.
