At the outset, Mr.Patil, learned counsel appearing for the CBI, on instructions, submitted that, after rejection of the application filed by the applicant below Exh.175 in CBI Special Case No. 86 of 2011 by the Trial Court by its impugned Order dated 18th August 2018, the Trial Court has already framed Charge against the applicant.

In view thereof, Mr.Tiwari, learned counsel appearing for the applicant, on instructions, seeks leave to withdraw the present application with liberty to agitate all his contentions before the Trial Court at the time of trial.

Leave and liberty granted.
