DATE: DECEMBER 21, 2021 P.C.:- 1] After arrest on 22/06/2021, Applicant came to be chargesheeted in C.R. No. 591 of 2021 registered with Kandivali Police Station for the offence punishable under Sections 188, 268, 270, 274, 275, 276, 419, 420, 465, 467, 486, 470, 471 and Section 34 of the IPC, under Sections 43 66(C ) read with Section 3 of the I.T. Act, under Section 42 of Disaster Management Act, 2005 and under Sections 18(A), 18(B), 24, 27, 28, 28(A) of Drugs and Cosmetic Act, 1940. 2] The case of the prosecution is, the Applicant, a data entry operator, after having received illegal gratification transferred the data to another data entry operator Anjali for generating fake vaccination certificates. I am informed that already an amount of Rs 2250/- which was illegally received by Applicant from Accused No.4 is recovered. 1/2

901 BA-4083-21.doc 3] The role attributed to the Applicant is that of providing details of illegal beneficiaries and get the fake vaccination certificates generated. As such, complicity of the Applicant is to the extent of providing names and get vaccination certificates generated.

4] In the aforesaid backdrop, considering the incarceration of the Applicant for last six months and the role attributed to the Applicant, case for bail is made out.

5] Applicant is directed to be released on bail in in C.R. No. 591 of 2021 registered with Kandivali (West) Police Station for the offence punishable under Sections 188, 268, 270, 274, 275, 276, 419, 420, 465, 467, 486, 470, 471 and Section 34 of the IPC, under Sections 43 66(C ) read with Section 3 of the I. T. Act, under Section 42 of Disaster Management Act, 2005 and under Sections 18(A), 18(B), 24, 27, 28, 28(A) of Drugs and Cosmetic Act, 1940, on executing P.R. Bond in the sum of Rs 15,000/- with one or more sureties in the like amount. Applicant shall neither directly or indirectly try to influence the prosecution witnesses nor tamper with the evidence. Applicant, if found involved, in the similar type of offence, prosecution is at liberty to move the Court for cancellation of his bail. 6] Application is disposed of.
