Heard the learned counsel for the parties.

The learned counsel for the appellant submits that resolution dated 12.9.2014 of the respondent Company was defeated in a meeting held on 25.10.2014.

In view of these subsequent developments nothing survives in the present Appeal from Order. It becomes infructuous. He seeks permission to withdraw the same. Same is allowed.

Appeal from Order is dismissed as withdrawn in view of subsequent developments Mohite 1/2
