By this application, the applicants seek pre-arrest bail in connection with C.R. No.268 of 2019, registered with the Nagpada Police Station, Mumbai for the alleged offences punishable under Sections 353, 186, 189, 332 r/w 34 of the Indian Penal Code.

Learned A.P.P, on instructions states that the applicants had reported to the Investigating Officer as directed vide order dated 6th September, 2019.

Perused the papers. According to the prosecution, applicant No.1's son had gone to the Police Station and a quarrel took place between Sahzeb Firoz Shaikh and applicant No.1's son. It is alleged that a dispute arose as applicant No.1's complaint was not being taken by the Police. It appears that in the quarrel that ensued in the Police Station, the applicant No.1's son assaulted Sahzeb Firoz Khan. It is further alleged that when the Police intervened, the applicants allegedly abused the Police and broke the window. Applicant No.1 is a housewife and applicant No.2 a student. Coaccused i.e applicant No.1's son was arrested and subsequently enlarged on bail.

In the facts, custodial interrogation of the applicants is not warranted. Accordingly, the application is allowed and the interim relief granted vide order dated 6th September, 2019 stands confirmed on the following terms and conditions;

ORDER
(i) In the event of the arrest, the applicants be enlarged on bail on furnishing P.R. Bond in the sum of Rs.10,000/- each, with one or two sureties in the like amount ;
(ii) The applicant shall co-operate in the investigation. 6.
The application is disposed of.
