This is an application for anticipatory bail in C.R. No.293 of 2021 registered with NRI Sagari Police Station, Navi Mumbai for offences punishable under Section 332, 353, 504 and 506 read with 34 of the Indian Penal code, 1860. The FIR was registered on 22nd November, 2021.

The complainant is working as driver in bus of Navi Mumbai Municipal Transport (NMMT). On 21st November, 2021 complainant was driving the bus. The bus slightly hit the vehicle driven by the accused from rear side. The accused got down from his car entered into the Bus caught his shirt collar and assaulted him. 3.

Learned Advocate for the applicant submitted that, custodial interrogation of the applicant is not necessary. The alleged incident had occurred on 21st November, 2021. The applicant need not be subjected Kiran Kawre

29-ABA-2766-2022.doc to custodial interrogation. At this stage the applicant has no criminal antecedents. The applicant is fillig affidavit stating that, he under take to this Court that, in future he would not indulge in similar offence. 4.

The affidavit is taken on record without prejudice to his defence in the trial Court. The incident is of November, 2021. Investigation is almost over.

Considering the aforesaid circumstances application can be allowed.

ORDER

(i) Criminal Anticipatory Bail Application No. 2766 of 2022 is allowed.

(ii) In the event of arrest of the applicant in connection with C.R. No.293 of 2021 registered with NRI Sagari Police Station, Navi Mumbai, the applicant be released on bail on executing P.R. Bond in the sum of Rs.20,000/- with one or more sureties in the like amount. (iii) The applicant shall report Investigating Officer on 17th, 18th and 19th October, 2022 between 11:00 a.m. to 1:00 p.m. and there after as and when called for till filing the charge-sheet.
