Nobody appears for petitioner. The learned APP submits that counsel then appointed has subsequently become APP. He submits that after proper inquiry the petitioner himself is found involved and hence, offence under section 353 IPC is already registered against him.
We find that this Court has on 13th March 2014 asked Principal District Judge, Pune to look into the grievance of the petitioner and to take appropriate steps and submit a report to this Court. Today, sealed envelope containing that report has been opened in Court. Report is dated 28th April 2014 and the Principal District Judge has found no substance in grievance of the petitioner. The learned APP states that petitioner is used to make false allegations against Jail officers.
pmw 2/2 wp-3693.13.doc In this situation, we direct Registry of this Court to serve a copy of report dated 28th April 2014 upon prisoner. We grant petitioner prisoner liberty to approach this Court again if he is aggrieved by that report. With this liberty and direction, we dispose of petition. (SMT. SADHANA S. JADHAV, J.) (B. P.
