For the reasons recorded in the judgment separately, the following order is passed :

O R D E R

The Appeal is partly allowed.

The conviction of the appellant for the offence punishable under Section 452 of Indian Penal Code is upheld and he is sentenced to the period already undergone.

Dusane 2/2 203 apeal 875.2014.doc The appellant is acquitted of the charge punishable under Section 324 read with 34 of Indian Penal Code. The sentence of fine is upheld.

Learned counsel for the appellant has put in best of his efforts to assist the Court, in view of this, his professional fees quantified as per rules, to be paid by High Court Legal Aid Committee.
