This is an application under Section 482 of the Cr.P.C. seeking to challenge the order dated 19th September, 2015, whereby the learned Metropolitan Magistrate, 53rd Court, Mulund, Mumbai has rejected the application under Section 156(3) of Cr.P.C. The order is revisable and hence the applicant is at liberty to file revision application before the Competent Court along with application for condonation, if so desired. The learned Sessions Judge shall consider the said application in the light of provision under Section 14 of the Limitation Act. The learned Sessions Judge shall decide the application as well as the application for condonation of delay on its own merits. This Court has not expressed any opinion on merits of the case.
