This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 78 of 2021 registered at Dehu Road Police Station, Pune for the offences punishable under Section 302 r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The learned Counsel for the applicant has placed on record a copy of the order passed by the Sessions Court dated 9 October 2021 in Kanchan P Dhuri 1 / 2

15-BA-4309-2021.odt Criminal Bail Application No.6400 of 2021. By the said order, the Sessions Court has released co-accused Vishal Chavan on bail. The learned Counsel for the applicant submits that role attributed to the present applicant and to the co-accused Vishal is identical. It is submitted that the applicant may be released on bail by extending the benefit of parity. 5.

I have perused the statement of eye-witnesses and there is a substance in the submission of learned Counsel for the applicant. Considering this fact, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Rohan Ravindra Jagtap be released on bail in Crime No. 78 of 2021 registered at Dehu Road Police Station, Pune for the offences punishable under Section 302 r/w. 34 of Indian Penal Code on furnishing P.R. Bond in the sum of Rs.50,000/- with one or two sureties in the like amount.

(iii) The applicant shall attend the concerned police station once in a month i.e. on 1st Wednesday between 11.00 a.m. to 2.00 p.m. till commencement of trial.
