The Learned Advocate appearing for the Appellant seeks leave of this Court to delete Respondent Nos. 3 to 9 from the above Second Appeal. Liberty is granted to delete Respondent Nos. 3 to 9 and amendment is allowed to be carried out forthwith.

The Learned Advocates appearing for the parties now tender consent terms dated 20th July, 2017. They submit that the consent terms be taken on record and the above Second Appeal be decreed in terms of the consent terms. The consent terms are taken on record and marked "X" for identification. The consent terms are signed by the Appellant. Respondent Nos. 1 and 2 have

KPPNair -2affixed their thumb impressions on the consent terms. All the signatories are present in Court. They have informed the Court that they have signed/put their thumb impressions on the consent terms. They have further informed the Court that the contents of the consent terms have been interpreted and explained to them in Marathi language by the Interpretor, High Court, Bombay, who is also present in Court. They have informed the Court that the Consent Terms are executed by them of their own free will and volition and without any force or coercion from any person/entity. The consent terms are also signed by the Advocates for the parties. The undertakings recorded in the consent terms are accepted. The above Second Appeal is disposed off in terms of consent terms marked "A". Civil Application No. 1573 of 2013 also stands disposed off. (S.J. KATHAWALLA, J.)
