Heard learned counsel for the applicant and learned APP.

This is an application for pre-arrest bail in respect of C.R. No. 86/2019 registered with Economic Offences Wing, Banking Unit-II, Mumbai, under Sections 406, 409, 420, 465, 471 read with 120-B of the Indian Penal Code, 1860 (hereafter "the IPC", for short).

It is alleged that the applicant was a director of Punjab Maharashtra Co-operative Bank (hereafter 'PMC Bank' for short). It is alleged that she has overlooked the process of 1/4
sanction/disbursal of hidden/unshown loan accounts of HDIL and its associate companies and caused a wrongful loss to PMC Bank, thereby, committed criminal acts of commission and omission.

It is the contention of learned counsel Shri Niteen Pradhan appearing on behalf of the applicant that the applicant was not concerned with the day-to-day affairs and working of the PMC Bank. It is submitted that she went to Canada in August, 2019 and she is keen to come back to India and co-operate with the investigation. Several directors having similar role as the applicant are released on bail.

Learned APP submits that the charge-sheet in respect of the accused nos.20 to 44 has been filed on February 17, 2022. The applicant is the original accused no.22. The applicant's custodial interrogation, therefore, is not required. Learned APP submitted that the applicant should co-operate with the investigation and that would sufoce. 6.
It is further submitted that the look out notice has been issued as the applicant was not available for the purpose of the investigation. It is submitted that the 2/4
applicant is returning back to India on January 29, 2023 and will co-operate with the investigation.

In this view of the matter, as the custodial interrogation of the applicant is not required, a request may be made to the investigating ofocer of the Economic Offences Wing to revoke the look out notice. Hence the following order.
O R D E R
(a) Application is allowed.
(b) In the event of arrest in connection with C.R. No. 86/2019 registered with Economic Offences Wing, Banking Unit-II, Mumbai, the applicant shall be released on bail on furnishing P.R. Bond to the extent of Rs.50,000/- with one or more sureties in the like amount.
(c) The applicant shall report to the concerned police station on 2nd, 3rd and 4th February, 2023, between 11.00 a.m. and 2.00 p.m. and thereafter, as and when called for.
(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Ofocer and shall not tamper with evidence.
(e) The applicant shall furnish the details of her 3/4
residential address and phone numbers to the investigating ofocer.

Needless to mention that as the custodial interrogation of the applicant is not required and as the applicant is now coming back to India, the look out notice has lost its significance and appropriate orders will obviously be passed by the investigating ofocer to that effect.
