This is an application under Section 438 Cr.P.C. filed by the aforesaid applicant apprehending his arrest in C.R.No. 665 of 2017 registered with Yerwada Police Station, Pune for offences under Section 406, 409 and 420 of IPC.

Heard Mr. Deshmukh, the learned Counsel for the applicant and Shri Agarkar, the learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties .

The records prima facie reveal that this Court by detail order dated 11th April, 2018 has granted interim bail to the applicant on condition that the applicant shall report to the Investigating Officer for a period of one week from 16th April, 2018. The learned Counsel for the applicant submits that pursuant to the Order dated 11th April, 2018, the applicant had reported to the Investigating Officer and that he has been interrogated.

The learned APP concedes that the applicant has been interrogated. He submits that the investigation is almost completed and chargesheet will be filed within fifteen days. The learned APP further submits that the presence of the applicant is no longer required in custody.

Considering the reasons stated in the interim order dated 11th April, 2018, so also considering the statement made by the learned APP, the application is allowed on following terms. (i) In the event of arrest of the applicant in Crime No.665 of 2017 registered at Yerwada Police Station, the applicant be released on furnishing PR Bond in the sum of Rs. 1,00,000/- (Rupees One Lakh Only) with one or two solvent sureties in the like amount, to the

satisfaction of the Investigation Officer.

(ii) The applicant shall provide his permanent as well as temporary address, if any, and his contact details to the Investigating Officer; (iii) The applicant shall not change his residential address without prior intimation to the Investigation Officer; (iv) The applicant shall not tamper with the evidence or interfere with the complainant and the other witnesses in any manner.
