The order dated 09.08.2012 rejecting the Application Exh.16 filed by the Petitioner/Appellant for withdrawal of the suit at the Appellate stage is taken exception to by way of the above Petition. The said Application has been rejected principally on the ground that the Suit in question being RCS No.9 of 1999 has been adjudicated after a full trial and therefore, now cannot be allowed to be withdrawn. In my view, having regard to the said reason, no exception would be taken to the impugned order. The Writ Petition is accordingly dismissed. [R.M. SAVANT, J] BGP.
