The application has been placed on the board for speaking to the minutes of the order dated 23rd February, 2015. Mr. Mehta, appearing for the applicant points out that, the transfer sought by the applicant of the matrimonial proceedings from the Family Court, Bandra, Mumbai was to the Court of Civil Judge Senior Division, Ahmednagar and that the reference to the Court of "Civil Judge Senior Division, Parner in District-Ahmednagar" is not correct. There is no

* 2/4 * Court of Civil Judge Senior Division, Parner in the District-Ahmednagar. In the circumstances, the words "Parner, District" from the order be deleted and the order be read accordingly.

The second correction sought is in the appearance shown in the cause-title. Mr. Mehta, states that his name has been incorrectly mentioned as "Mr. S.N. Mehta" instead of "Mr. C.N. Mehta". The necessary corrections be carried out in the order and the order be read accordingly.

This Miscellaneous Civil Application filed under Section 24 Civil Procedure Code is for transfer of M.J. Petition No.A-371 of 2014 pending in the Family Court, Bandra, Mumbai to the Court of Civil Judge Senior Division, Ahmednagar, where the applicant wife is presently residing. The marriage of the applicant and the respondent had taken place on 24th April, 2012. A daughter, Diksha was born to them on 22nd

One of the grounds for transfer set out in the application is that the child being in the care and custody of the applicant, it is difficult for her to commute between Ahmednagar and Mumbai for attending to the Court proceedings. Considering the age of the child and the specific difficulty relating to the child, the application is allowed in terms of prayer clause (a).
