DATE :

10th February 2015.

P.C.

1] The learned Advocate for the applicant. The applicant is aggrieved by the order passed by the learned Judicial Magistrate, First Class, Thane in Criminal application No.247 of 2014 directing the complaint of the applicant to be listed for recording of statement of applicant on oath, as per the provisions of section 200 of the Cr.P.C. The applicant is aggrieved by the said order inasmuch as he wanted his complaint to be sent to the police for investigation under section 156(3) of the Cr.P.C.

2] In my opinion, the application has no case to make a

YBG apl1054-14 grievance against the order of the Magistrate, inasmuch as, the applicant himself had prayed before the Magistrate for reliefs either under section 156(3) or under section 200 of Cr.P.C. 3] I do not find anything wrong in the order passed by the Magistrate. The application stands dismissed. ( M.L.TAHALIYANI, J.)
