By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant-wife seeks transfer of Petition No.A-516 of 2015 filed by the Respondent-husband from the 4th Family Court at Pune to the Court of Civil Judge, Senior Division at Karad. 2.

Both the parties are highly educated. The Respondent is a Software Engineer with 3D PLM Software Pvt. Ltd. According to him, his monthly salary is Rs.81,000/- (gross) and Rs.71,000/- (net). The Applicant/wife is a Professor in Krishna College at Karad and having a monthly salary of Rs.20,000/- (gross) and Rs.18,500/- (net).

Since it will be inconvenient for the Applicant to travel from Karad, District : Satara to Pune and it will also be equally inconvenient for the Respondent to

kpd 2 / 2 906-MCA-154-2017.sxw travel from Pune to Karad, District : Pune, parties have agreed to conduct the proceedings through video conferencing.

In the event of the Family Court at Pune not being equipped to conduct the matter through video conferencing, the Respondent undertakes to provide a laptop, WIFI and other equipments required to conduct the matter/trial through video conferencing. Similarly, the Applicant shall arrange for a laptop, WIFI and other equipments required to conduct the matter/trial through video conferencing. 5.

The Respondent who is present in Court undertakes to start making payment of the maintenance to the Applicant as ordered by the Family Court, Pune upon receipt of the certified copy of this order. He states that if he decides to file an Appeal from the said order, he shall make payment without prejudice to his rights and contentions in appeal. The undertaking is accepted. 6.

The above Miscellaneous Civil Application is accordingly disposed off. ( S.J.KATHAWALLA, J. )
