Heard. This application is filed seeking directions to the Respondents to register an FIR on the basis of the Applicant's complaint dated 26th February 2016. Learned APP having taken instructions from the officer concerned, states that the Applicant's said complaint was enquired into under the supervision of Additional Commissioner of Police and it was revealed that the offence is not made out. She submitted that in that view of the matter, police are not going to register FIR. 2.

In the circumstances, we find that the Applicant's remedy is to approach the learned Magistrate by way of private complaint, if he so desires.
