Parties through their Counsel. The grievance of the Petitioner is that though the Deputy Director of Education, Mumbai Region, Mumbai vide order dated 30 th September, Exhibit-I has directed the Education Officer (Secondary) Respondent No.2 to reconsider the order dated th September, 2016 by which the Petitioner has been declared

WP.11670/2016(12) surplus, but instead of reconsidering the matter as directed vide order dated 30 th September 2016 the Respondent No.2 is bent upon to relieve the Petitioner.

Keeping in view the order dated 30 th September, 2016 we find that since the Deputy Director of Education, Mumbai Region, Mumbai has already directed the Education Officer Respondent No.2 to reconsider the matter we dispose of this Petition by directing the Education Officer to take fresh decision in the matter taking into consideration the direction contained in the communication dated 30 th September, 2016 Exhibit-I as expeditiously as possible preferrably within 3 weeks from the receipt of the copy of this order. Till fresh decision is taken as aforesaid the Petitioner be allowed to continue at her present place of posting.

The Petition stands disposed of. Parties to act on the authenticated copy of this order.
