...Respondent
Mr. Feroz A. Shaikh, advocate for the Petitioners. Smt. Aruna S. Pai, APP for State.
CORAM : B.P. DHARMADHIKARI & SMT. SADHANA S. JADHAV, JJ.
DATE : NOVEMBER 28, 2019.
P.C.:
Heard for some time. Effort of the learned Counsel is to show that on the date of the alleged incident petitioners were not at Karad. Support is being taken of E-Tickets to show that they were away.
Material on record does not show that E-Tickets were provided to Investigating Officer so as to enable him to examine the claim of the petitioners.
Those tickets are also not filed on the record of trial court.

52.wp4034.18.doc We therefore grant petitioners leave to place those documents on record of trial court since charge-sheet is already filed. The trial Court can examine those documents and petitioners can lead necessary evidence to show that they were not in Karad and therefore, charges are false. With these observations and liberty, as also keeping contentions of the petitioners open, we dispose of petition. (SMT. SADHANA S. JADHAV, J) (B.P. DHARMADHIKARI, J) Talwalkar
