Advocate for the petitioner submits that respondent nos.3 and 4 expired in September, 2015. He submits that in Trial Court, respondent no.2 defendant no.2 filed application for transposing him as plaintiff. That application is pending as on today. He submits that petitioner may be granted liberty to file fresh petition for same cause of action as and when application filed by defendant no.2 in Trial Court allowed. Same is permitted. Hence, following order is passed:

Writ Petition stands dismissed as withdrawn with liberty as prayed.
