By this petition under Article 227 of the Constitution of India the petitioner challenges order dated 28.07.2015 passed by the Civil Judge, Senior Division, Ichalkaranji below exhibit 69 in special civil suit No. No.15/2011 rejecting their application for adding them as party in the suit. 3.

The learned counsel for the petitioner submits that in the meantime, special civil suit No. 15/2011 is finally decided by the trial court. He seeks permission to withdraw the petition. To that effect, he made an endorsement on a farad. Same is taken on record and marked "X" for Basavraj G Patil 1/2
