This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.1002 of 2021 registered at Chakan police station, District Pimpri-Chinchwad for the ofences punishable under Sections 307, 326, 323, 504 & 506 read with 34 of the Indian Penal Code (IPC) and Section 4 read with 25 of the Arms Act.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State and perused the First Information Report (FIR).

There was a dispute between the family of the complainant and the family of present applicant on account of some immovable property. It appears that on 17 August 2021 at about 9.30 p.m., the dispute arose between the family of the Dinesh S. Sherla 1/2

2/2 907-ba-2915-22.doc complainant and the family of the applicant on account of some trivial issue and in the said dispute, it is alleged that the present applicant and other co-accused assaulted the complainant and his family members by sword and attempted to kill them. Prima facie the incident does not appear to be premeditated. The applicant is in jail for more than 1 year. There are no other criminal antecedents. I am, therefore, inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicant be released on bail in C.R. No.1002 of 2021 registered at Chakan police station, District PimpriChinchwad for the ofences punishable under Sections 307, 326, 323, 504 & 506 read with 34 of the IPC and Section 4 read with 25 of the Arms Act on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C] The applicant shall not enter into the limits of Taluka Khed till conclusion of trial, except to attend the dates before the trial court.

D] The applicant shall provide the address of the place where he is going to reside after his release and his mobile number to the concerned ofcer of Chakan Police Station. [N.R.BORKAR, J.] Dinesh S. Sherla 2/2
