By this application, the applicant granted pre arrest bail by the order dated 30-07-2013 has prayed for modification in the order of furnishing one or two sureties for the bail amount. It is submitted that the applicant is from the hutment area and as such he is not able to procure surety having solvency document showing solvency for more than Rs. 15,000/-.

The request is objected by the learned APP by submitting that the order passed is proper. It is difficult to accept the objection as the learned APP was not supposed to dilate about the correctness of the order but only the number of solvent sureties to be provided for the purpose of bail order. It is astonishing that in spite of order being passed on 30-07-2013, the police have also not arrested the applicant.

Having regard to it, the application is allowed. The part of the order dated 30-07-2013 furnishing one ore two sureties is modified now to the tune of the applicant furnishing more than one sureties for making up the amount of bail.

Application stands disposed of.
