Heard learned Counsel for the applicant and learned APP for the State. Perused the chargesheet and the statement of eye witnesses, Vinod Suryavanshi. Prima-facie it appears that, the offence was not premeditated. It is submitted that, the incident had taken place under the influence of liquor and at the spur of moment. However, it cannot be ignored that there is incriminating material against the applicant. At this stage, the learned Counsel for
