This is an application received through Jail with a prayer for expediting the trial of the applicant and other 45 inmates of Thane Central Prison pending on the file of Special Court under the Protection of Children from Sexual Offences Act at Thane. 2.

Heard the learned counsel appointed to represent the applicant and the learned APP.

The learned counsel for the applicant submitted that there is only one Court at Thane to try the offences under the provisions of Protection of Children from Sexual Offences Act at Thane and the said Court is over burdened and therefore, it is unable to take up the cases of under trial prisoners on priority. It is submitted that the applicant and other persons are Page-1/2

7-appln. 585-16 languishing in Jail since 2014 and therefore, their trial may be expedited or they may be released on bail.

The learned APP. on instructions submitted that the said Court has been assigned with regular sessions cases also and that is the reason the said Court is over burdened. He further on instructions submitted that the prosecution is extending all necessary assistance to the concerned Court to expedite the trials pending on its file and will further render all necessary and relevant assistance to the concerned Court in that behalf. 5.

In view of the above, the learned Judge seized of the trial of the applicant and other similarly situated under trial prisoners is hereby requested to make an endeavour to expedite the trials of the said prisoners chronologically as per its own turn.
