During the pendency of the present application, the applicant - Mahesh Suresh Kamble had filed an application through jail before the Sessions Court. The application was argued by the applicant in person. Notice was issued to the Colaba Police Station and accordingly Colaba Police Station had filed reply which is at Exhibit 3 through prosecution. It is pertinent to note that the prosecution had not brought to the notice of the Court that a similar application is filed and is pending before the High Court. The learned Sessions Court by an order dated 4.3.2017 has enlarged the applicant on bail. Since the application was filed through jail and argued in person, it was incumbent upon the Colaba Police Station to bring to the notice of the Sessions Court that a similar application is pending

Mhi 2 BA-2067-16.sxw before the High Court. The learned counsel Mrs. Anjali Patil submits that she has no knowledge about the filing of the application before the Sessions Court. The prayer has become infructuous and hence the application stands disposed of.
