Mr. Limaye, learned counsel, on instructions of the petitioner, seeks leave to withdraw the petition with liberty to file an appeal challenging the decree passed in R.C.S. No.142 of 2012 by the Civil Judge, Senior Division, Pandharpur. Leave with liberty as prayed for, is granted. The writ petition is dismissed as withdrawn. 2.

It is made clear that we have not gone into the merits of the matter and, all rights and contentions of the respective parties are kept expressly open. In the event, the petitioner files an appeal against the said decree, the same shall be decided independently in accordance with law.
