After the Petitioner's Counsel argued the matter for sometime and his attention was invited to the provisions of Administrative Tribunal Act, 1985, particularly the position as narrated in the Writ Petition that the Petitioner claims to be working as an Associate Professor in Commerce in the Government college at Daman in the Union Territory of Daman and Diu and that being under the control of the Ministry of Human Resources, Government of India, the Administrator 1/2

912-WP12155-17.DOC of Union Territory of Daman, Diu and Dadara and Nagar Haveli, he fairly states that the grievance raised comes within the purview of the definition of the term 'service matter' as defined in the Administrative Tribunal Act, 1985. By virtue of Section 14 of that Act the Petitioner has alternate, equally efficacious remedy of approaching the Central Administrative Tribunal and that Tribunal, empowered by law, could grant complete relief. In view of this position, leave is granted to withdraw this Petition with liberty to approach the Tribunal. 2.

The Writ Petition is disposed of as withdrawn with liberty as prayed.
