By this Application under Section 115 of the Code of Civil Procedure, 1908 (for short 'C.P.C.'), the applicant, hereinafter referred to as defendant, has challenged the judgment and order dated 31/07/2015 passed by the learned IIIrd Joint Civil Judge, Junior Division, Malegaon below Exhibit 190 in Regular Civil Suit No. 30 of 1995. By that order, the learned trial Judge rejected the application made by the defendant under Order 7 Rule 11 (a) and (d) of C.PC. for rejection of the plaint.
