1] By this application, the applicant has sought condonation of delay of one year and 158 days in filing the appeal against the judgement of acquittal.

2] Heard the learned Counsel for the applicant and respondent. In view of the reasons spelt out in paras 2 and 3 of the application, which in my considered view constitute sufficient ground for condoning the delay, the delay in filing the appeal is condoned. Appeal be registered in the event there are no office objections and subject to payment of cost of Rs.5000/- to be paid to Tata Cancer Hospital. Application disposed of.
